Please read them carefully and if you disagree with the TOU in any way, then do not use this Site or any of the Services. Anchor Behavioral Health reserves the right to post changes to the TOU on this Site at any time. If we make any material changes to this TOU, we will post the updated TOU here, along with its effective date, and notify you by email or by means of a notice on our Site. If any TOU changes are not acceptable, you must stop your use of this Site. In these TOU, "Anchor Behavioral Health" and "we" refer to Anchor Behavioral Health, LLC, and "User" or "you" refer to each visitor to this Site.

 

If you subscribe/purchase/retain to any Services offered through this Site, you may also be subject to additional terms and conditions applicable to such Services, if any.

Non-Licensed Services

While Anchor Behavioral Health does provide licensed health care services, the Site does not provide any professional licensed services, such as but not limited to, medical advice and diagnosis, medical treatment, psychology, or psychiatric services.  Nothing in this Site or through use of the Site creates a provider-patient relationship.  You should not send us any protected health information (PHI as defined under HIPAA) through this Site.

 

Minors

We do not provide information or services to minors, and if you are under 18, and at least 13 years of age, you may only use this Site and/or the Services with the active involvement of a parent, guardian or other supervising adult. You may not use this Site if you are under 13 years of age.

Content Shared by Users

To the extent we enable you to, and you choose to post or share any content or materials, you will be: (a) granting Anchor Behavioral Health a fully transferable, sub-licensable (with rights to sublicense, including, without limitation, through multiple tiers) to display, perform, reproduce, modify, transfer, distribute and create derivative works from the User Content and to associate your public profile information (if any) with such User Content, in any media formats and through any channels (whether now known or hereafter developed) and waiving any moral rights in favor of Anchor Behavioral Health with respect to such use of the User Content; (b) granting Anchor Behavioral Health a perpetual, world-wide, royalty-free, fully paid-up, non-exclusive license to allow your materials to be edited and displayed by Anchor Behavioral Health on its Site, and accessed by Users, for the purposes and on the terms as set out in these TOU; (c) agreeing to indemnify and hold harmless Anchor Behavioral Health and its Users from any claim or demand made by any third party due to or arising out of your User Content; and (d) representing that you own or otherwise have the right to post the User Content, that the User Content is accurate, that use of the User Content on the Site does not violate any laws, and that the materials will not cause injury to any person, including without limitation to the intellectual property, personal or privacy rights of others. Anchor Behavioral Health Widgets

  • Anchor Behavioral Health reserves the right at any time to terminate or modify your permission to display the Widget. The Widgets are subject to change from time to time in our sole discretion. We may cease to return content from the Widget at any time in our sole discretion.

Account Creation

Some of the Services offered by Anchor Behavioral Health may require you to create an account. When you create an account, you agree that you have the authority to create that account and that all information you provide will be true, accurate, current, and complete. You are solely responsible for keeping your login information (e.g., user ID and password) accurate, secure, and confidential. You are also responsible for any activity resulting from use of your login information. You agree to immediately inform us if you suspect that your login information has been compromised. We are not liable to you for any losses or damages you incur resulting from unauthorized use of your login information.

If you login or sign in using social networking functionality, e.g., Instagram, Facebook, X, google, etc. you agree to abide by the applicable social network’s terms and conditions.

 

Webinars

 In the event that Anchor Behavioral Health makes webinars available (each a “Webinar” and together “Webinars”), the below applies in addition to the rest of the terms of this TOU. You understand and agree to receiving communications from Anchor Behavioral Health and/or providers of these Webinars, including as set forth in the “Communications” section of this TOU. Anchor Behavioral Health reserves the right at any time and for any reason and without notice to you, to change, modify, suspend, or cancel access to and/or any and all of the Webinars and/or services related to the Webinars, in whole or part.

 

All Webinar content is owned by or licensed to Anchor Behavioral Health and/or its licensed content providers, and all such rights are reserved. You may not reproduce, upload, transmit, distribute, publicly display, sell, publish, copy, or otherwise use the Webinar, and/or any content or materials provided in connection with any Webinar for any commercial purpose without Anchor Behavioral Health’s express written consent.

 

The appearance of any instructor in any Webinar is not and shall not be deemed an endorsement or recommendation of that instructor by Anchor Behavioral Health and the views expressed in any Webinar are those of the instructor and not Anchor Behavioral Health.

 

Compliance with Laws

You agree to comply with all applicable laws in connection with your purchasing and/or viewing of any services. Further, access to our services from certain territories is prohibited. This TOU, and any applicable TOS, constitute the entire agreement between each User and Anchor Behavioral Health governing the User's access to and use of the Site and its Services, and supersede all prior agreements regarding its subject matter. The TOU shall be governed by the laws of the State of Hawaii without giving effect to any principles of conflicts of laws. Each User hereby attorns and agrees to the non-exclusive jurisdiction of the courts of Honolulu, Hawaii.

 

The failure by a User or Anchor Behavioral Health to exercise any right or to enforce any provision of this TOU shall not constitute a waiver of such right or provision. The parties have agreed that this contract and all related documents be drafted in English. 

 

This TOU may be superseded by subsequent agreement executed between User and Anchor Behavioral Health.

THIS NOTICE DESCRIBES HOW INFORMATION ABOUT YOU MAY BE USED AND DISCLOSED. IT ALSO DESCRIBES HOW YOU CAN OBTAIN ACCESS TO THIS INFORMATION. PLEASE REVIEW IT CAREFULLY.

This practice respects its legal obligation to keep health information that identifies you private. We are obligated by law to give you notice of my privacy practices. This Notice describes how this practice protects your health information and what rights you have regarding it.

USES AND DISCLOSURES FOR TREATMENT, PAYMENT, AND HEALTH CARE OPERATIONS

We may use or disclose your protected health information (PHI), for treatment, payment, and health care operations purposes with your consent. To help clarify these terms, here are some definitions:

• “PHI” refers to information in your health record that could identify you, as defined in 45 CFR § 106.103.

• “Treatment, Payment and Health Care Operations” – Treatment is when we provide, coordinate, or manage your health care and other services related to your health care. An example of treatment would be when we consult with another healthcare provider, such as your family physician, psychiatrist, psychologist, or therapist. – Payment is when we obtain reimbursement for your healthcare. Examples of payment are when we disclose your PHI to your health insurer to obtain reimbursement for your health care or to determine eligibility or coverage. – Health Care Operations are activities that relate to the performance and operation of my practice. Examples of healthcare operations are quality assessment and improvement activities, business-related matters such as audits and administrative services, and case management and care coordination.

• “Use” applies only to activities within my practice group, such as sharing, employing, applying, utilizing, examining, and analyzing information that identifies you.

• “Disclosure” applies to activities outside of my practice group, such as releasing, transferring, or providing access to information about you to other parties.

• “Patient” and “Client” refer to the recipient of therapeutic services in this practice, and these two terms are used interchangeably in this Notice.

USES AND DISCLOSURES REQUIRING AUTHORIZATION

We may use or disclose PHI for purposes outside of treatment, payment, or healthcare operations when your appropriate authorization is obtained. An “authorization” is written permission above and beyond the general consent that permits only specific disclosures. In those instances when we are asked for information for purposes outside of treatment, payment, or healthcare operations, we will obtain an authorization from you before releasing this information. We will also need to obtain an authorization before releasing certain notes we have made about our conversation during a private, group, joint, or family counseling session, which we may have kept separate from the rest of your medical record. These notes are given a greater degree of protection than PHI. You may revoke all such authorizations (of PHI or Notes) at any time, provided each revocation is in writing. You may not revoke an authorization to the extent that (1) we have relied on that authorization or (2) if the authorization was obtained as a condition of obtaining insurance coverage, law provides the insurer the right to contest the claim under the policy.

USES AND DISCLOSURES WITH NEITHER CONSENT NOR AUTHORIZATION

We may use or disclose PHI without your consent or authorization in the following circumstances:

• Child Abuse – If we have reason to believe that child abuse or neglect has occurred or that there exists a substantial risk that child abuse or neglect may occur in the reasonably foreseeable future, we must immediately report the matter to the appropriate authority.

• Adult and Domestic Abuse – If we, in the performance of our professional or official duties, know or have reason to believe that a dependent adult has been abused and is threatened with imminent abuse, we must promptly report the matter to the appropriate authority.

• Health Oversight Activities – If the professional board or authority is investigating my competency, license, or practice, we may be required to disclose protected health information regarding you.

• Judicial and Administrative Proceedings – If you are involved in a court proceeding, and a request is made for information about the counseling or psychotherapy services provided to you and/or the records thereof, such information is privileged under Hawaii law, and we shall not release information without the written authorization of you or your legally appointed representative or a court order. The privilege does not apply when you are being evaluated for a third party or where the evaluation is court-ordered. We shall inform you in advance if this is the case.

• Serious Threat to Public Health or Safety – We may disclose protected health information regarding you where there is clear and imminent danger to you or another individual or to society, and then only to appropriate professional workers or public authorities. If you are at risk, we may also contact family members or others who could assist in providing protection.

• Worker’s Compensation – If you have filed a worker’s compensation claim, we may be required to disclose PHI about any services we have provided to you that are relevant to the claimed injury.

  • De-Identified PHI – PHI that has been de-identified pursuant to 45 CFR § 164.514 may be disclosed for various purposes, such as, but not limited to, research or sharing with other health care providers.

PATIENT’S RIGHTS AND OUR DUTIES

Patient’s Rights:

• Right to Request Restrictions – You have the right to request restrictions on certain uses and disclosures of protected health information. However, we are not required to agree to a restriction you request.

• Right to Receive Confidential Communications by Alternative Means and at Alternative Locations – You have the right to request and receive confidential communications of PHI by alternative means and at alternative locations. (For example, you may not want a family member to know that you are seeing us. On your request, we will send your bills to another address.)

• Right to Inspect and Copy – You have the right to inspect or obtain a copy (or both) of PHI in my mental health and billing records used to make decisions about you for as long as the PHI is maintained in the record. We may deny your access to PHI under certain circumstances, but in some cases you may have this decision reviewed. On your request, we will discuss with you the details of the request and denial process.

• Right to Amend – You have the right to request an amendment of PHI for as long as the PHI is maintained in the record. We may deny your request. On your request, we will discuss with you the details of the amendment process.

• Right to an Accounting – You generally have the right to receive an accounting of disclosures of PHI. On your request, we will discuss with you the details of the accounting process.

• Right to a Paper Copy – You have the right to obtain a paper copy of the notice from me upon request, even if you have agreed to receive the notice electronically.

  •  Right to a copy of this Privacy Notice – You may receive a copy of this notice.

  •  Right to choose someone to act for you - You have the right to choose someone to act on your behalf with a medical power of attorney or as a legal guardian. 

Our Duties:

• We are required by law to maintain the privacy of PHI and to provide you with a notice of my legal duties and privacy practices with respect to PHI.

• We reserve the right to change the privacy policies and practices described in this notice. Unless we notify you of such changes, however, we are required to abide by the terms currently in effect.

• If we revise my policies and procedures, we will notify you accordingly. we will usually provide you with the revision during an in-person meeting, but if necessary, we will send you the revision via postal mail, or electronic mail.
